1. Who We Are & What We Do
My Executive Bio ("Company," "we," "us," or "our") is a professional web design and copywriting service based in Broward County, Florida. We specialize in creating personal executive websites for professionals in healthcare, financial services, and related industries. Our services are delivered remotely and all client communications are conducted by written correspondence — including email and online forms.
Our website is located at https://myexecutivebio.com. By accessing or using our website, submitting an intake form, or purchasing any service, you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety.
2. Acceptance of Terms
These Terms & Conditions constitute a legally binding agreement between you and My Executive Bio. By submitting a purchase, completing an intake form, making a payment, or otherwise engaging with our services, you confirm that:
- You are at least 18 years of age and have the legal capacity to enter into a binding contract.
- You have read and understood these Terms & Conditions in full.
- You agree to be bound by these terms, including our Refund Policy and Limitation of Liability provisions.
- If you are acting on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.
If you do not agree with any part of these terms, you must not use our services. We reserve the right to refuse service to anyone at our sole discretion.
3. Our Services
My Executive Bio provides professional website design, copywriting, and related digital services for executives and professionals. Our current service offerings include, but are not limited to:
| Service | Description | Delivery |
|---|---|---|
| Essential Executive Website | 3-page professional website with copywriting and SEO | 48 hours |
| Premium Executive Website | 5-page website with portfolio, testimonials, and advanced SEO | 48 hours |
| Executive Brand Package | 7-page website with blog, media kit, and speaking page | 48 hours |
| Website Maintenance Subscription | Monthly updates, content refreshes, and SEO maintenance | Ongoing |
All services are delivered digitally. Delivery timelines are estimates based on our standard workflow and assume timely receipt of all required materials from the Client. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
The scope of each service is defined at the time of purchase. Any work beyond the agreed scope — including additional pages, additional revisions beyond those included in the package, or additional features — may be subject to additional fees, which will be communicated to you in writing before any additional work begins.
4. Ordering & Payment
All orders are placed through our online intake form and payment system. By completing a purchase, you authorize My Executive Bio to charge the full amount to your selected payment method. All prices are listed in United States Dollars (USD) and are subject to change without notice. The price in effect at the time of your order confirmation is the price you will be charged.
Payment is due in full at the time of purchase unless otherwise agreed in writing. We do not begin work on any project until payment has been received and confirmed. We use Stripe as our payment processor; by making a payment, you also agree to Stripe's terms of service. We do not store your full credit card information on our servers.
For subscription services, your payment method will be billed automatically on a recurring monthly basis. You may cancel your subscription at any time by contacting us at [email protected]. Cancellations take effect at the end of the current billing cycle. No partial-month refunds are issued for subscription cancellations.
5. Refund & Return Policy
5.1 General Policy
All sales are considered final once work has commenced. Because our services involve the creation of custom, personalized digital content — including original copywriting, design, and strategy tailored specifically to each individual client — they are not returnable or exchangeable in the traditional sense. We do not offer refunds simply because a client has changed their mind, decided they no longer need the service, or is dissatisfied with the general direction of their personal brand.
We invest significant time, expertise, and resources into every project from the moment work begins. A refund request does not automatically entitle a client to a refund. We evaluate each request individually, in good faith, based on the criteria set forth in this policy.
5.2 Pre-Work Cancellation
If you wish to cancel your order before work has commenced — meaning before we have sent you any initial drafts, design mockups, or copywriting — you may request a cancellation by emailing [email protected] within 24 hours of purchase. In this case, we will issue a full refund, less any payment processing fees charged by our payment processor (typically 2.9% + $0.30).
Cancellation requests submitted after the 24-hour window, or after any project work has begun, will not qualify for a full refund and will be evaluated under the criteria below.
5.3 Post-Delivery Refund Criteria
Once a project has been delivered, we do not issue refunds based on subjective dissatisfaction, personal preference changes, or general disappointment with the outcome. We are a professional creative service, and creative work inherently involves subjective judgment. The following criteria must be met for a refund request to be considered:
Material Failure to Deliver
We failed to deliver the agreed-upon number of pages or core features as defined in your purchase package, and we were unable to remedy the deficiency within a reasonable timeframe after being notified in writing.
Documented Technical Non-Functionality
The delivered website contains fundamental technical errors — such as pages that do not load, forms that do not function, or broken navigation — that we were notified of in writing and failed to resolve within 7 business days.
Significant Deviation from Agreed Scope
The delivered work is demonstrably and materially different from the written scope agreed upon at the time of purchase, and the deviation was not caused by incomplete, inaccurate, or delayed information provided by the Client.
Refund requests must be submitted in writing to [email protected] within 7 calendar days of delivery. Requests submitted after this window will not be considered. All requests must include a clear, specific, written description of the issue, along with any supporting documentation or screenshots.
5.4 What Does Not Qualify for a Refund
The following circumstances do not qualify for a refund under any circumstances:
- You changed your mind after purchase or after delivery.
- You are dissatisfied with the creative direction, tone, or style, where such direction was consistent with the information you provided during intake.
- You did not achieve the business outcomes you hoped for — including but not limited to more job offers, speaking engagements, board appointments, media coverage, leads, or any other professional result. See Section 6 for our full No Guarantee of Results policy.
- You provided incomplete, inaccurate, or delayed information during the intake process, which affected the quality or scope of the deliverable.
- You approved a draft and then changed your mind about the direction after approval.
- You experienced technical issues on your own device, browser, or internet connection that are unrelated to the website itself.
- You decided to use a different service provider after purchase.
- You did not read or review the delivered work within the 7-day review window.
- Your dissatisfaction is based on comparison to a competitor's product or a hypothetical alternative.
- You are requesting a refund for a monthly subscription after the billing cycle has already begun.
5.5 Revision Policy
Rather than issuing refunds, our preferred resolution for dissatisfied clients is to offer revisions within the scope of the original project. Each package includes a defined number of revision rounds. We believe that open, written communication during the revision process resolves the vast majority of concerns. We are committed to delivering work that accurately represents your professional identity and will work diligently to address legitimate feedback.
Revisions must be requested in writing within 7 calendar days of delivery. Revision requests submitted after this window may be treated as new work and subject to additional fees.
5.6 Partial Refunds
In cases where a refund is deemed appropriate under this policy, we reserve the right to issue a partial refund that reflects the work already completed, resources already expended, and any third-party costs incurred on your behalf. The amount of any partial refund will be determined at our sole discretion and communicated to you in writing.
5.7 Chargebacks
If you initiate a chargeback or payment dispute with your bank or credit card provider without first contacting us and allowing us a reasonable opportunity to resolve the issue, we reserve the right to dispute the chargeback, provide documentation of services rendered, and pursue any outstanding balance through available legal remedies. We take fraudulent chargebacks seriously and will respond to every dispute with full documentation of the work performed.
6. No Guarantee of Results
Plain Language Summary
We build great websites. We do not guarantee that your website will get you a job, a board seat, a speaking engagement, more clients, media coverage, or any other professional outcome. Results depend entirely on factors outside our control.
My Executive Bio is a website design and copywriting service. We are not a career coaching firm, a talent agency, a public relations company, a lead generation service, or a business development consultant. Our sole service is the creation of a professional personal website.
Any statements made on our website, in our marketing materials, in email communications, or by our team members regarding potential outcomes — including but not limited to increased job opportunities, board appointments, speaking engagements, media inquiries, professional leads, client acquisition, revenue growth, or career advancement — are illustrative examples and aspirational descriptions only. They are not promises, guarantees, or representations of what you will experience.
Professional outcomes depend on a wide range of factors entirely outside our control, including but not limited to: your industry, your experience level, market conditions, your personal networking efforts, your communication skills, economic conditions, competition in your field, and the decisions of third parties. A professional website is one tool among many in a comprehensive personal branding strategy. It is not a guarantee of any professional result.
We expressly disclaim any guarantee of:
- Employment offers or job placement
- Board seat appointments or nominations
- Speaking engagement invitations
- Media coverage or press mentions
- Increased revenue, clients, or leads
- Search engine rankings or SEO performance
- Social media followers or engagement
- Any other specific professional or financial outcome
By purchasing our services, you acknowledge and agree that you are purchasing a creative and technical service — the delivery of a professional website — and not a guaranteed business or career outcome.
7. Intellectual Property
Upon receipt of full payment and delivery of the completed project, My Executive Bio assigns to you all rights, title, and interest in the original written content and design elements created specifically for your project. You are free to use, modify, publish, and distribute your website and its content as you see fit.
We retain the right to display your completed website in our portfolio, case studies, and marketing materials unless you notify us in writing at the time of purchase that you wish to keep your project confidential. We will never disclose your personal information in connection with any portfolio use without your consent.
Any third-party assets incorporated into your website — including stock photography, fonts, icons, or licensed software — remain subject to their respective licenses. We will inform you of any third-party assets used and ensure they are properly licensed for your use.
Our company name, logo, website content, blog posts, and all other materials on https://myexecutivebio.com that were not created specifically for your project remain the exclusive intellectual property of My Executive Bio and may not be reproduced, distributed, or used without our express written permission.
8. Client Responsibilities & Content
You are responsible for providing accurate, complete, and timely information during the intake process. The quality of your website is directly dependent on the quality and completeness of the information you provide. We are not responsible for inaccuracies, omissions, or deficiencies in the final product that result from incomplete or inaccurate information provided by you.
You represent and warrant that any content, materials, images, or information you provide to us — including biographical information, photographs, logos, and professional credentials — is accurate, truthful, and does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. You agree to indemnify and hold harmless My Executive Bio from any claims arising from content you provided.
You are responsible for reviewing all delivered content for accuracy before publishing or sharing your website. We make every effort to accurately represent your professional background, but we are not liable for factual errors that result from information you provided or failed to correct during the revision process.
9. Limitation of Liability
To the maximum extent permitted by applicable law, My Executive Bio, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost revenue, lost business opportunities, loss of data, loss of goodwill, or any other intangible losses — arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability to you for any claims arising out of or related to these Terms or our services exceed the total amount you paid to us for the specific service giving rise to the claim in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
10. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, My Executive Bio expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that our services will meet your specific requirements or expectations.
- Any warranty that our services will be uninterrupted, timely, secure, or error-free.
- Any warranty regarding the accuracy, reliability, or completeness of any content we produce on your behalf.
- Any warranty that defects in the services will be corrected.
We make no warranty that your website will rank on any particular search engine, generate any particular level of traffic, or achieve any particular business outcome. SEO results are inherently uncertain and depend on factors outside our control, including search engine algorithm changes, competition, and your ongoing content strategy.
11. Indemnification
You agree to defend, indemnify, and hold harmless My Executive Bio and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your breach of these Terms & Conditions.
- Any content or information you provided to us that is inaccurate, misleading, or infringes upon the rights of a third party.
- Your use of the website or services in violation of any applicable law or regulation.
- Any claim by a third party arising from your use of the website we created for you.
12. Dispute Resolution & Governing Law
12.1 Good Faith Resolution First
We genuinely want every client to be satisfied with our work. Before either party initiates any formal legal proceeding, both parties agree to make a sincere, good-faith effort to resolve any dispute through direct written communication. If you have a concern, please email us at [email protected] with a clear description of the issue. We commit to responding within 5 business days and to working collaboratively toward a fair resolution.
We strongly encourage resolving disputes without legal counsel. Most issues can be resolved quickly and fairly through honest, direct communication. Engaging attorneys on both sides is expensive, time-consuming, and rarely in either party's best interest for disputes of this nature.
12.2 Governing Law
These Terms & Conditions and any dispute arising out of or relating to them or our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
12.3 Exclusive Jurisdiction & Venue
Any legal action, suit, or proceeding arising out of or relating to these Terms or our services that is not resolved through good-faith negotiation shall be brought exclusively in the state or federal courts located in Broward County, Florida, Florida. Both parties irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in Broward County, Florida.
12.4 Waiver of Jury Trial
To the fullest extent permitted by applicable law, both parties waive their respective rights to a jury trial in any action or proceeding arising out of or relating to these Terms or our services.
12.5 Time Limitation on Claims
Any claim or cause of action arising out of or related to our services or these Terms must be filed within one (1) year after such claim or cause of action arose, regardless of any statute of limitations to the contrary. Claims filed after this period are permanently barred.
13. Modifications to Services or Terms
We reserve the right to modify, update, or discontinue any aspect of our services or these Terms & Conditions at any time. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page. We may also notify existing clients by email of significant changes.
Your continued use of our services after any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our services. Changes to pricing, service scope, or delivery timelines will not affect orders that have already been placed and paid for prior to the change.
14. Privacy & Communications
We respect your privacy. Any personal information you provide to us — including your name, email address, professional background, and payment information — is used solely for the purpose of delivering our services and communicating with you about your project. We do not sell, rent, or share your personal information with third parties except as necessary to deliver our services (e.g., payment processors) or as required by law.
All client communications are conducted by written correspondence — email and online forms. We do not conduct business by telephone. By providing your email address, you consent to receive service-related communications from us. You may opt out of marketing communications at any time by emailing [email protected], though we may still send you transactional emails related to your active projects.
We implement reasonable security measures to protect your information. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
15. Miscellaneous Provisions
Entire Agreement
These Terms & Conditions, together with any written project scope or order confirmation, constitute the entire agreement between you and My Executive Bio with respect to our services and supersede all prior or contemporaneous communications, representations, and agreements, whether written or oral.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of My Executive Bio.
No Agency or Partnership
Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and My Executive Bio. You do not have the authority to bind us to any obligation.
Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, cyberattacks, or other events of force majeure. In such cases, we will notify you promptly and make every reasonable effort to resume performance as soon as possible.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
